Terms and Conditions
General Terms and Conditions for Internet Transactions of Morawetz
Our general terms and conditions become effective with each customer order. They can be viewed at any time on the Morawetz website.
1. Order
The contract between the customer and MORAWETZ is established by an order from the customer and its acceptance by MORAWETZ. The order signed by the buyer is binding; for internet orders, the submission of the order is binding. MORAWETZ accepts the order by:
- Sending the customer an order confirmation (by fax, email, or regular mail), or
- Delivering the ordered goods (including invoice or delivery note).
The prices valid on the day of delivery, as published on the internet, will be charged unless other agreements have been made in writing. All prices are listed excluding VAT. If no prices are specified, the shop primarily serves as a catalog, and the specific prices will be provided promptly in the form of an offer.
2. Delivery
We deliver via parcel service and postal service. Shipping costs are shown during the online ordering process. Stocked goods leave our premises within 3 days. Other items have a delivery time that depends on that of our upstream supplier. Precise information will be provided on an order-specific basis.
3. Payment Terms
This agreement is subject to Austrian law. The place of jurisdiction is Austria/Vienna. Invoicing is done in Euros. The payment methods are listed in detail in the online shop. We reserve the right to refuse a payment method chosen by the customer, even after an order has been placed, and to insist on prepayment. In this case, we will contact the customer immediately.
4. Transfer of Ownership
Delivery is subject to retention of title. The delivered goods remain the property of MORAWETZ until the purchase price has been paid in full.
5. Warranty
For all products offered on the internet, the guaranteed functionality is 12 months. This period begins with delivery. During the warranty period, the customer may request repair or replacement from MORAWETZ. The customer must send the defective item, after consultation with MORAWETZ, postage unpaid but at their own risk, together with the invoice and delivery note, to MORAWETZ, Seeböckgasse 26, A1160 Vienna - Austria. For goods with a value of less than 40.00 Euros, the return shipping costs are borne by the buyer. If the defect cannot be remedied by repair or replacement within a reasonable period, the buyer may, at their option, demand a reduction in the purchase price or cancellation of the purchase contract. Claims of the buyer for warranty are dependent on the buyer reporting obvious defects within two weeks and non-obvious defects within six months of delivery. The warranty expires if changes or repairs are made to the goods without the written consent of MORAWETZ. The assignment of warranty claims to third parties is excluded.
6. Liability
The liability of MORAWETZ, regardless of the legal basis, is limited to a maximum of 10 times the purchase price (excluding VAT) of the item that caused the damage or is the subject of the claim or is directly related to it. The higher amount applies. MORAWETZ is not liable for lost profits, lost savings, or damages from third-party claims.
7. Cancellation Policy
- Right of Withdrawal
You can revoke your contract declaration within two weeks without stating reasons in text form (e.g., letter, fax, email) or by returning the item. The period begins at the earliest upon receipt of this notification. To comply with the withdrawal period, timely dispatch of the revocation or the item is sufficient. The revocation is to be sent to our address specified on the order confirmation.
- Consequences of Withdrawal
In the event of an effective withdrawal, the services received on both sides must be returned, and any benefits derived (e.g., interest) must be surrendered. If you cannot return the received service in whole or in part or only in a deteriorated condition, you may have to compensate us for the loss of value. This does not apply to the surrender of items if the deterioration of the item is solely due to its inspection – as would have been possible for you in a retail store. In addition, you can avoid the obligation to compensate for the loss of value by not using the item as your own property and refraining from anything that impairs its value.
For returns from a goods delivery with a total order value of up to 40 Euros, you must bear the delivery costs (shipping costs) and the return costs if the delivered goods correspond to the ordered goods. Otherwise, the return is free of charge for you.
Items that cannot be shipped by parcel will be picked up from you.
- Special Notes
Your right of withdrawal expires prematurely if your contractual partner has begun with the execution of the service with your express consent before the end of the withdrawal period or if you have initiated this yourself (e.g., by download etc.).
8. Data Protection
Customer data will not be disclosed to third parties. Credit card data will be deleted after the transaction has been completed.
We inform our customers at irregular intervals by email newsletter. Customers who do not wish to receive this can notify us in the "Note to us" field. Of course, the newsletter can be unsubscribed at any time by sending a simple email. All associated data will then be deleted.
